Dear Public Records Officer: This is a request for public records pursuant to the Public Records Act, Chap. 42.56 RCW (PRA). Please produce the following public records for which time is of the essence:
You are specifically required to search any private accounts or devices for responsive records pursuant to Nissen v. Pierce County, 183 Wn.2d 863, 357 P.3d 45 (2015). Please provide PDF copies of any affidavits produced.
For each responsive record that you contend is exempt from public disclosure, in whole or in part, please specifically identify the record by subject, title, author, custodian, and date, and explain how a specific statutory exemption applies to each record as required by RCW 42.56.210(3) and City of Lakewood v. Koenig, 182 Wn.2d 87, 343 P.3d 335 (2014). For each record that is only partially exempt from public disclosure, please provide a redacted copy of that record.
For those responsive records that currently exist in electronic format (such as email, Word, or PDF files), please provide those documents (including all metadata) in such native electronic format. Please provide email records in a “.PST” file unless that file format does not work with the relevant agency’s email system. For those documents that exist only in paper form, please scan those documents into PDF files. Where paper copies of records available in electronic form contain handwritten marks or notes, please provide both the native electronic record and a scanned PDF copy of the paper record. Please provide all records by Internet file transfer (unless your response is small enough to send by email).
Failure to comply with this request for public records may require you to pay attorney fees as well as penalties under RCW 42.56.550(4). Yousoufian v. Sims, 168 Wn.2d 444, 229 P.3d 735 (2010).
Whether or not your agency asserts that any requested records are exempt from disclosure you are required by RCW 42.56.100 to protect all records from loss or destruction until this matter is resolved.
