Sahalee Way Corridor Improvements RFQ

The City of Sammamish Department of Public Works is soliciting interest from firms with expertise in Civil engineering and multi-modal transportation planning to provide analysis and conceptual design to improve Sahalee Way NE from NE 28th Place north to the city limits. Additional services to provide complete design and construction engineering may be added later through supplemental agreements.

1. Is the City willing to agree to a modification of Item 5 in the Professional Services Agreement with the addition of the underlined text shown here? A proposed teaming partner for this project has requested this modification.

• Consultant shall defend, indemnify, and hold the City of Sammamish, its officers, officials, employees and volunteers harmless from any and all claims, injuries, damages, losses or suits including attorney fees, arising out of or resulting from the willful misconduct or negligent acts, errors or omissions of the Consultant in performance of this Agreement, except for injuries and damages caused by the sole negligence of the City of Sammamish.

The City agrees to accept the proposed change to the standard indemnification provision in Paragraph 5 for this design contract.
