East Lake Sammamish Trail Segment 2B Shoreline Substantial Development Permit (SSDP2016-00415)

STATUS UPDATE (01/31/2019): Following closure of the public hearing on November 20, 2017, the City of Sammamish Hearing Examiner (HE) issued a decision of denial dated January 5, 2018 on the Shoreline Substantial Development Permit (SSDP) for phase 2B of King County’s East Lake Sammamish Regional Trail (KC ELST 2B).

This City HE Decision was appealed to the Washington State Shorelines Hearing Board (SHB) on January 31, 2019 by multiple parties, including King County, and assigned SHB file No. 18-004c. Following completion of the State SHB appeal hearing process, the SHB ruled on November 7, 2018 in its written decision that the City shall approve the SSDP (City File No. SSDP2016-00415) for the KC ELST 2B in accordance to the Board’s direction. 

Following the SHB ruling, and after transmittal to the City’s HE, the HE issued a new decision on January 31, 2019 approving the SSDP for the KC ELST 2B subject to conditions. There is no further appeal period opportunity relating to this SSDP. The Washington State SHB and the City HE decisions are included below.

The City HE and the Washington State SHB decisions on the SSDP are planning level decisions and do not authorize construction activity. The applicant and project proponent, King County Parks, must apply for and receive construction permit(s) before work may commence to build the new trail segment.

City staff have been in communication with King County and it is estimated that King County will provide construction permit application sometime in the end of February. King County’s application for construction permits will include the 90% construction plans/project design. At that time staff will begin review of the construction permit application and supporting materials for compliance with the January 31, 2019 City HE SSDP.

Description

The City of Sammamish received an application on October 19, 2016, requesting a Shoreline Substantial Development Permit (SSDP) to improve 3.5 miles of the existing soft-surface interim East Lake Sammamish Trail, extending from SE 33rd Street to Inglewood Hill Road. This interim trail will be widened to 12 feet of paved surface with 2-foot gravel shoulders and a 1-foot clear zone on both sides.

In conjunction with the trail widening, associated activity will take place which includes: earthwork; drainage improvements related to the trail; culvert replacements to improve fish passage; construction of rest areas with benches; improved intersections and sight triangles; mitigation and habitat enhancement; landscaping and fencing; and access and traffic control (bollards, striping, signage, etc.).

The subject properties are located in the R-4 zone and in close proximity to Lake Sammamish which is a Shoreline of Statewide Significance. This proposal is located within the Lake Sammamish Shoreline Residential Environment Designation.  An SSDP is now a Type 4 process which includes a Staff Recommendation and Final Decision by the City’s Hearing Examiner.
